Abstract:
The article presents a comprehensive theoretical, methodological and normative-structural analysis of the classifiers and lists used in the State Land Cadastre of Ukraine under Cabinet of Ministers Resolution No. 1051. The starting premise is that classification in a cadastre is not an auxiliary technique but a constitutive element of cadastral governance: it is classification that transforms a continuous, multidimensional and legally heterogeneous land reality into an ordered body of data suitable for State recognition, spatial planning, taxation, valuation, monitoring, environmental reporting and inter-agency interoperability. The article proposes an original definition of a cadastral entity as a legally significant, spatially localized, semantically identified and registrable unit of cadastral description for which the cadastre records at least an identifier, location, legal regime, temporal validity and classification attributes. It is demonstrated that many current cadastral classifiers are open-ended or quasi-open-ended, and therefore their modernization should reconcile legal certainty with the capacity to register emerging objects and regimes. Based on an analysis of Appendices 2–6 and 58–63 to the Procedure for Maintaining the State Land Cadastre, the study identifies the main structural defects: mixing zones, boundaries, territories, networks and regime-forming objects in one list; conflating restrictions, encumbrances and protected territories; constructing agro-production soil codes through exhaustive enumeration rather than generative rules; failing to distinguish actual and planned land-use units; uneven internal logic of the classifier of designated land-use purposes; and replacing a classifier of meliorative networks with a de facto register of existing systems. The article develops a package of reforms aimed at evolutionary rather than revolutionary modernization: restructuring the classifier system by ontological levels, introducing separate classifiers for encumbrances, protected areas, actual and planned land use, soil variants and regime-forming objects, and ensuring integration with KATOTTG, NK 018:2023, INSPIRE, HILUCS, LUCAS and LADM. The scientific novelty lies in proposing an integrated model of cadastral classification modernization as the semantic foundation of land administration. Its practical value consists in providing draft-oriented solutions for amending Resolution No. 1051 and aligning the State Land Cadastre with European requirements.
